PURCHASERS AGREE TO AND ARE BOUND BY THE FOLLOWING CONDITIONS AND LICENSING RESTRICTIONS
LICENSEE’S purchase fee constitutes payment for a non-exclusive, non-transferable license, lasting for ninety-nine (99) years from the date of purchase. This means you cannot loan or resell this music to any 3rd party. The license is granted only to you, the LICENSEE. Any use not specifically included in this agreement shall be considered to be outside the terms of this agreement.
APPROVED USES: This license allows LICENSEE the right to use digital content (downloaded musical selections) purchased from BruceTunz.com as accompaniment to, or set in synchronization with, the following forms of media: 1)Photograhic or slideshow presentations on CDs, DVDs, or the Internet, 2) As part of a personal or commercial website, but only together with images, text, or other visual/audio content, in such a way that music is used in a supporting/secondary role, and is not the main feature of the website. Music may be streamed but shall not be made available for download, 3) Use of the music within an event video(s) for your clients, corporate presentation videos, PowerPoint presentations, portfolio presentations, web video clips, within flash animation, slide show presentations, promotional videos and promotional DVDs (not exceeding 5000 promotional units or copies and not packaged for retail sale), 4) Music on-hold or background for your business.
RESTRICTIONS: The following restrictions apply to the use of music purchased from BruceTunz.com: 1) Background Use Only - This license does not include the right to use the music as a solo performance – you may only use the music as background or accompaniment to your video and photographic presentations, 2) Not for Retail Use - This license does not allow you to include the music in any product made available for retail sale. You may, however, use the music freely within your or your clients’ personal & promotional videos and photo presentations as outlined in this document. You must contact BruceTunz.com to purchase an upgraded license if you plan to make more than 5000 copies of any promotional or client video, 3) Broadcasting Restrictions - This license does not allow you to include the music in commercial advertising on TV, Satellite, Film, or Radio, or within any TV or Film production, 4) Editing - You may edit and/or loop each song to extend/trim its length for creative, technical, or timing purposes, 5) Sampling or re-mixing - You may not use samples or edit the music within another musical composition or add a singer to an existing instrumental track. You may, however, use the track as a background ‘bed’ under a separate voiceover (spoken, non-singing) performance.
COPYRIGHT: All rights, title, and copyrights in and to the music (including, but not limited to, artists’ images, artist photographs, music, and lyrics) remain the property of their respective copyright owners. You may not use music to promote any business that sells or licenses music.
CREDITS: We recognize that credits may not always be included on your Wedding, Event or promotional projects. If credits do appear on your video or photo projects, each song used must be credited as: “Song Name” performed by “Artist Name,” courtesy of BruceTunz.com.
AMENDMENT: License may only be amended by BruceTunz.com by giving written notice (email and/or USPS certified mail) to LICENSEE within 30 days of any revision being made. License may not be amended by LICENSEE unless by agreement in writing from BruceTunz.com, 16627 Benson Road South, Renton WA 98055 Email: customerservice@brucetunz.com
TERMINATION: Without prejudice to any other rights, BruceTunz.com may terminate this license if LICENSEE fails to comply with the terms and conditions within this license. If such an event occurs, you must destroy all of your copies of BruceTunz.com music or return copies to BruceTunz.com immediately upon notice of termination.
LIABILITY: Our products are provided "as is" with the sole warranty that defective CDs and downloads will be replaced at our discretion within 30 days upon proof of purchase. No other warranties or conditions are expressed or implied.
NO LIABILITY FOR DAMAGES: In no event is BruceTunz.com, its Artists, or its partners liable for any damages whatsoever arising out of the use of or inability to use this product. In any case, BruceTunz.com’s entire liability under any provision of this License shall be limited to the amount actually paid by you for the license.
This Agreement contains the sole and entire understanding between BruceTunz.com and LICENSEE. No representations, oral or otherwise, express or implied, other than those contained in this Agreement have been made. BruceTunz.com and LICENSEE understand that the terms of this Agreement are contractual and not mere recitals.
GOVERNING LAW: The laws of the State of Washington govern this agreement.
